These definitions have the following meanings:
1.1. Directive on consumer rights – directive 2011/83/EU of the European Parliament and of the Council of 25 October 2011 on consumer rights;
1.2. Client – a natural person, legal person or organizational unit which does not have legal entity, but is given legal capacity by certain regulations and makes an order in the Internet Store:;
1.3. Consumer – a person making a legal action not directly related to his trade or profession..
1.4. Civil Code – Act of 23 April 1964 r. (Journal of Law No. 16, item 93 with amendments);
1.5. Conditions – these terms and conditions of the provision of services by electronic means within the framework of the e-shop KnotMe;
1.6. Internet Store (Store) – internet website at knotme.eu address, via which the Client may place Orders
1.7. Goods – products presented in the Internet Store;
1.8. Sales contract – a contract for sales of Goods according to the Civil Code, concluded between KME sp. z o.o. and a Client within the Internet Store;
1.9. Act on Specific Terms and Conditions of Consumer Sale– act of 27 July 2002 on special consumer sales of goods and on amendments in the Civil Code (Journal of Law No. 141, item 1176 with amendments);
1.10. Act on Providing Services by Electronic Means – act of 18 July 2002 on providing services by electronic means (Journal of Law No. 144, item 1204 with amendments);
1.11. Order – the declaration of the Client’s will, directly aiming at the conclusion of Sales contract, especially specifying the type and amount of Goods.
2.1. These Terms and Conditions specify the rules and regulations for using the Shop provided under knotme.eu.
2.2. These Terms and Conditions are Terms and Conditions described in art. 8 of the Act on Providing Services by Electronic Means.
2.3. The Shop, operating under knotme.eu, is run by KME sp. z o.o., os. Na Skarpie 24 31-905, Kraków Poland Tax ID (NIP) 6783199178.
2.4. These Terms and Conditions regulate in particular:
a) the rules for the registration and use of the account within the online Shop;
b) terms and conditions for electronic booking within online Shop;
c) the terms and conditions of placing orders within the online Shop;
d) the rules of contract of sale with the use of services provided in the online Shop.
2.5. Using the Internet Store is possible if Client’s ICT system fulfills following technical requirements:
a) Internet Explorer version 9.X or later with cookie enabled, or
b) Firefox version 8.X or later with cookie enabled, or
c) Chrome version 15.X or later with cookie enabled, or
d) Opera version 16.X or later with cookie enabled, or
e) Safari version 5.X or later with cookie enabled, or
f) a minimum screen resolution of 800 x 600 pixels.
2.6. In order to use the Internet Store the client should get the access to the computer workstation or terminal device which has access to the Internet.
2.7. The Owners can include limitations on use of the Shop, e.g. Clients who are under 18 and such will be set out in the Shop.
2.8. Clients can access these Terms and Conditions at all times through the main menu and a link on the knotme.eu/terms website and they can download it and print it.
2.9. Information about Goods, which appears in the Shop, in particular their descriptions , measurements, and prices, invite to conclude a contract of sale in regards to art. 71 of the Civil Code.
3.1. In order to use the Online Shop you have to register.
3.2. Registrasion is made by completing and accepting the registration form available on one side of the Store.
3.3. Registration shall bear by filling in the registration form provided on one side of the Store.
3.4. KnotMe may deprive the Customer’s right to use the online store, and may limit its access to the whole Store or it’s part with immediate effect if the Client violates the Conditions, especially if the Client:
a) during the registration in the Internet Store has given incorrect, inaccurate or outdated personal data, which misleds or violates the rights of third parties,
b) via the Internet Store has violated the property of third party, especially other Clients of the Internet Store,
c) will undertake other actions which will be considered by KME sp. z o.o. as inconsistent with the existing law or general rules of using the Internet or detrimental to the good name of KME sp. z o.o..
3.5. A person who has been deprived of the right to use the online store can not register again without prior consent of KME sp. z o.o..
3.6. In order to ensure the safety of transmission of messages and data related to the services provided in the Website services, Internet shop take technical and organizational measures appropriate to the seriousness of the safety of services, in particular measures to prevent acquisition and modification by unauthorized personal data transmitted over the Internet.
3.7. The Customer is obliged in particular to:
a) do not act in any way contrary to the law, e.g. promoting violence, making defamation comments or violating the well-being and rights of third parties,
b) using the Internet Store in a way that does not disturb its functioning, especially by using special software or devices,
c) not to send or place on the Store unsolicited commercials (spam)
d) use the online Shop without major inconvenience to other Customers, and for KME sp. z o.o.,
e) use any content contained in the Online Store only for personal use,
f) use the Internet Store in a way that is compliant with the provisions of the law, binding on the territory of Polish Republic (or in accordance with the national law of the country of the Client), Terms and Conditions, as well as general rules of using the Internet.
4.1. In order to conclude sales agreements via Online Shop, the customer should go to the website knotme.eu, choose the model, size, color and additional accessories, taking technical steps based on the displayed messages and information available on the website..
4.2. The choice of the Goods ordered by the customer is made by adding them to your cart.
4.3. When submitting orders – until Customer press the button “PLACE ORDER” – Customer has the possibility to modify the data (eg. adress, delivery type) and the selection of the Goods. To do this Customer can follow onscreen messages and the information available on the website.
4.4. After entering by the Client all the necessary data in Order form, Client will see a summary of placed Order. Summary of Order will contain the following information:
a) the object of the contract,
b) unit and the total price of the products or services, including delivery costs and additional costs (if applicable),
c) method of payment,
d) method of delivery,
e) time of delivery,
f) additional comments.
4.5. To send an Order, Customer must accept the Terms and Conditions, provide personal data marked as mandatory and press the button ” Place Order.”
4.6. Customer by sending Order, agrees to conclude a contract of sale with KontMe.
4.7. After placing orders, the customer receives an e-mail containing a final confirmation of all the essential elements of the Order.
4.8. The Agreement shall be treated as concluded from the moment of receipt by the Client an e-mail referred above.
4.9. The sales agreement is in English of the content in accordance with the Terms and Conditions.
5.1. Delivery of Goods is limited to the countries of the European Union (excluding Cyprus) and takes place at the address indicated by the Client when placing Order.
5.2. Delivery of ordered goods is via courier or mail. The cost of delivery will be indicated at the time of finalizing Order.
5.3. Production time of goods is up to 10 working days from the date of placing the order by the Customer.
5.4. Delivery time is between 3 and 20 working days from the date of sending the Order to the Customer depending on the country of residence of the Customer.
5.5. Confirmation of the essential elements of the sale of goods is carried by sending to Customer e-mail, and by adding the parcel containing the Goods printout of confirmation, specification orders and invoice.
6.1. Prices of Goods depending on the option selected by the customer are given in Polish zloty or in euros and include all components.
6.2. The customer can pay by:
a) credit or debit card using Stripe,
b) PayPal system.
7.1. Client, who is a Consumer shall be entitled to – under the law – the right to withdraw from a distance contract, without giving reasons, making a statement in writing within 14 days and send it to the KME sp. z o.o..
7.2. The 14-day deadline is counted from the date on which the delivery of the Goods or in the case of shipping in parts of the receipt by the Customer last part of the Order.
7.3. The right of withdrawal by the Consumer is excluded in the case of:
a) the supply of goods made to the consumer’s specifications or clearly personalized;
b) the supply of sealed goods which are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery;
7.4. In case of withdrawal from a distance contract, the contract is considered null and void. What has been received received shall be returned in the unchanged state, unless a change was necessary in the ordinary course of business. Return should be done without delay and no later than within 14 days.

7.5. Goods returned by the Client shall be packaged in a suitable manner, to ensure no damage during shipping.
7.6. If the Client has chosen the way of delivery of the Goods other than the cheapest regular delivery offered by KME sp. z o.o., the seller is not obliged to refund the Client incurred extra costs
7.7. The cost of packing and returning the goods shall be borne by the Customer.
8.1. KnotMe as the seller is liable to the Customer who is a consumer, the nonconformity of goods with the contract purchased by the consumer, to the extent specified by the Act on the specific terms and conditions of consumer sale.
8.2. Claims arising from the breach of customer rights guaranteed by law, or under these Terms and Conditions, should be send to support@knotme.eu. KnotMe committed to consider any complaint within 14 days, and if it was not possible, to inform the customer in that period, when KnotMe adjust a claim.
9.1. KnotMe take measures to ensure the full operation of the Store, to the extent consistent with the technical knowledge and undertakes to remove within a reasonable time any irregularities reported by customers.
9.2. The customer is obliged to immediately notify KnotMe about any irregularities or interruptions in functioning of Shop.
9.3. Customer can report irregularities related to the functioning of the Shop directly to the address of KME sp. z o.o. or via e-mail: support@knotme.eu or by using the contact form..
9.4. Customer should provide full name, mailing address, description and date of irregularities related to the functioning of the Shop.
9.5. KnotMe committed to consider to consider any complaint within 14 days, and if it was not possible, to inform the Customer in that period, when the complaint will be considered.
10.1. Settlement of any dispute arising between KnotMe and the Customer who is a Consumer shall be subjected to the courts having jurisdiction over the address of the Customer.
10.2. Settlement of any dispute arising between KnotMe and the Customer who is not a consumer within the meaning of the Civil Code, shall be subjected to the courts having jurisdiction over the address of the KnotMe.
10.3. In matters not regulated in the Terms and Conditions, the provisions of the Civil Code, the provisions of the Act on Providing Services by Electronic Means, the provisions of the Directive on consumer rights and other relevant provisions of Polish law or state law appropriate for the place of residence of the customer are applicable.
